Voluntary Disclosure
A Voluntary Disclosure is a formal notification to the FTA of an error or omission in a previously filed VAT return where the net impact exceeds AED 10,000.
When Required
- The error results in a net VAT impact of AED 10,000 or more (overpayment or underpayment).
- The error relates to a previously filed VAT return.
- The error was discovered by the taxpayer (not the FTA).
The 20-Business-Day Window
Once an error exceeding AED 10,000 is discovered, the taxpayer must file a Voluntary Disclosure within 20 business days of becoming aware of the error.
Filing Process (Form VAT211)
- Log in to EmaraTax and navigate to the VAT section.
- Select "Submit Voluntary Disclosure" on the row of the relevant VAT return.
- Enter error details:
- Type of original declaration (VAT return or tax assessment)
- Description of the error
- Whether the error leads to tax payable or refundable
- Amount of the error
- Update the tax return values to reflect corrected figures.
- Upload supporting documentation (invoices, contracts, calculations).
- Submit.
What Happens After Filing?
The FTA reviews the Voluntary Disclosure and either:
- Acknowledges (accepts) the disclosure
- Requests more information if clarification is needed
- Rejects if the disclosure is not valid
Status can be tracked in EmaraTax (Drafted, Pending, Acknowledged, Rejected).
Penalty Implications
Filing a Voluntary Disclosure before the FTA discovers the error significantly reduces penalties:
- A fixed penalty of 5% of the error amount may apply (reduced rate).
- The taxpayer must also pay the corrected tax amount plus applicable late payment penalties.
If the FTA discovers the error first (through an audit), significantly higher penalties apply:
- Up to 300% of the tax amount for evasion.
- 50% for errors discovered by the FTA without disclosure.
Multiple Errors
Multiple errors in the same tax period must be disclosed separately on an error-by-error basis. Each error is a separate entry in the Voluntary Disclosure form.
When NOT to File
- If the error is below AED 10,000 (correct in next return).
- If another Voluntary Disclosure for the same tax period is already pending.
- If the error was already corrected through a previous Voluntary Disclosure.
