What are FTA Public Clarifications?
The Federal Tax Authority issues Public Clarifications (VATP series) that provide binding interpretations of the VAT law and executive regulations on specific scenarios.
Legal Status
Public Clarifications are the authoritative interpretive layer above the legislation:
- They interpret the VAT Law and Executive Regulations.
- They are binding on the FTA — the FTA must apply the interpretation in the clarification.
- They provide taxpayers with certainty on specific VAT treatments.
- They supplement, but do not override, the legislation.
How They Differ from Other FTA Publications
| Publication Type | Legal Status | |---|---| | VAT Law (Federal Decree-Law) | Primary legislation | | Executive Regulations | Binding implementing rules | | Public Clarifications (VATP) | Binding interpretations of the law | | FTA Guides | Non-binding guidance | | FAQs | Non-binding information |
When to Use Public Clarifications
- When the law or regulations are ambiguous on a specific scenario.
- When the FTA has been asked to clarify the treatment of a specific transaction.
- When a taxpayer wants certainty on a complex VAT issue.
- When the law has been amended and the FTA provides interpretive guidance.
How to Find Them
Public Clarifications are published on the FTA website under the Clarifications section. Each clarification has a unique reference number (e.g., VATP1, VATP2, etc.) and covers a specific topic.
Worked Example
A business is unsure whether a specific digital service is subject to UAE VAT. It searches the FTA website and finds a Public Clarification (VATP) that directly addresses this scenario. The clarification states that the service is subject to 5% VAT because the recipient is in the UAE. The business applies this treatment with confidence, knowing the FTA is bound by its own clarification.
