VAT Registration Thresholds

UAE VAT registration is mandatory at AED 375,000 annual taxable supplies, voluntary at AED 187,500, with 30-day registration deadlines and AED 10,000 late registration penalties.

VAT Registration Thresholds

Overview

UAE VAT was introduced on 1 January 2018 under Federal Decree-Law No. 8 of 2017. It applies a 5% tax rate to most goods and services.

Mandatory Registration Thresholds

AED 375,000 - Mandatory Registration: Annual taxable supplies exceed AED 375,000 or anticipate exceeding within 30 days. Must register within 30 days of becoming eligible. Failure to register incurs penalties.

AED 187,500 - Voluntary Registration: Annual taxable supplies between AED 187,500 and AED 375,000. Can voluntarily register if expected to exceed threshold. Benefits: Recover input VAT on expenses.

Who Must Register?

Mandatory: UAE-based businesses with taxable supplies above AED 375,000, non-resident businesses making supplies to UAE customers, importers of goods into the UAE (above de minimis), government entities (with conditions), free zone companies (if making taxable supplies).

Voluntary: Businesses with taxable supplies AED 187,500 - AED 375,000, startups expecting to exceed thresholds, businesses wanting to recover input VAT.

Taxable Supplies

Included: Standard-rated supplies (5%), zero-rated supplies (0%), supplies subject to reverse charge.

Not included: Exempt supplies, supplies outside the scope of VAT.

Registration Calculation

For existing businesses: Total value of taxable supplies in the previous 12 months or anticipated in the next 30 days. For new businesses: Anticipated taxable supplies in the next 30 days or projected annual taxable supplies.

Multiple Entity Considerations

Each legal entity must register separately. Related entities may need to register as a tax group. Tax group registration available for commonly controlled entities. Tax group has a single TRN and files one return.

Registration Deadlines

Existing businesses: Within 30 days of becoming eligible. New businesses: Before exceeding the threshold, or within 30 days. Late registration penalty: AED 10,000. Backdated registration: FTA may backdate to the date of eligibility.

Deregistration

Must deregister if taxable supplies fall below AED 187,500 for 12+ months, business ceases to operate, or entity is dissolved or liquidated.

Free Zone Considerations

Free zone companies must register if they exceed thresholds. Designated zones have special rules for goods. Services from free zones are generally taxable. Imports from outside the UAE into a designated zone may be zero-rated.

Best Practices

Monitor taxable supplies monthly. Register proactively before threshold. Maintain accurate records. Consider voluntary registration for input VAT recovery. Plan for tax group registration if applicable. Understand designated zone rules. Engage a tax advisor for complex cases.
