Dispute Resolution Process
Step 1: Internal Resolution. Employee raises the issue with the employer. HR or management addresses the concern. Attempt to resolve internally. Document all communications.
Step 2: MoHRE Complaint. If internal resolution fails, employee files a complaint with MoHRE. Complaint can be filed online or at a MoHRE service center. Employee provides: employment contract, salary records, passport copy, Emirates ID, details of the dispute. MoHRE assigns a complaint reference number.
Step 3: MoHRE Mediation. MoHRE invites both parties for mediation. A MoHRE officer attempts to resolve the dispute. Mediation is free of charge. If resolved, a settlement agreement is signed. If not resolved, the case is referred to the labour court.
Step 4: Labour Court. Case referred to the labour court. Both parties present their case. Court hears witnesses and reviews evidence. Court issues a judgment. Either party can appeal the judgment.
Step 5: Appeal. Appeal must be filed within 15 days of the judgment. Appeal heard by a higher court. Final judgment is binding.
