Digital Services from Non-Residents

VAT treatment of digital services supplied by non-residents to UAE consumers, including the simplified registration scheme.

Digital Services VAT Treatment

What are Digital Services?

Digital services (also called "electronic services") are services delivered over the internet or an electronic network, requiring minimal human intervention. Examples:

  • Streaming services (video, music)
  • Software subscriptions and downloads
  • Mobile applications
  • E-books and digital publications
  • Cloud computing services
  • Online advertising
  • Online gaming

Place of Supply for Digital Services

The place of supply of digital services is where the recipient is located:

  • If the recipient is a UAE consumer (non-registered): UAE VAT applies.
  • If the recipient is a UAE-registered business: Reverse charge applies.
  • If the recipient is outside the UAE: Outside the scope of UAE VAT.

Non-Resident Suppliers

A non-resident supplier of digital services to UAE consumers must:

  1. Register for VAT in the UAE (simplified registration scheme), OR
  2. Appoint a tax agent to register and account for VAT on their behalf.

The simplified registration scheme allows non-residents to register without a physical presence in the UAE — they account for VAT on their UAE B2C digital services supplies.

B2B vs B2C

  • B2B (to registered businesses): The UAE business accounts for VAT under the reverse charge. The non-resident does not charge VAT.
  • B2C (to consumers): The non-resident must register under the simplified scheme and charge 5% VAT.

Worked Example

A US-based streaming service provides video streaming to UAE consumers for AED 50/month. The service is a digital service. Since the recipients are UAE consumers (not registered), the US company must register under the simplified scheme and charge 5% VAT (AED 2.50/month). If the same service is provided to a UAE-registered business, the business accounts for reverse charge VAT.

Practical UAE example

**US Streaming Service**: Netflix US provides streaming to UAE consumers for AED 50/month. Netflix must register under the simplified scheme and charge 5% VAT (AED 2.50). Total billed: AED 52.50. Netflix files VAT returns and remits the collected VAT to the FTA. If a UAE-registered business subscribes, the business accounts for reverse charge VAT on its own return.

Key takeaways

  • Digital services are services delivered over the internet with minimal human intervention.
  • Place of supply: where the recipient is located.
  • Non-resident suppliers to UAE consumers must register under the simplified scheme.
  • B2B: reverse charge; B2C: non-resident charges 5% VAT.
