E-commerce VAT Treatment
Online Marketplaces
Online marketplaces (e.g., Amazon, Noon) may be treated as the deemed supplier for VAT purposes:
- The marketplace accounts for VAT on supplies made through its platform to UAE consumers.
- The actual seller on the marketplace may not need to charge VAT if the marketplace handles it.
- This simplifies VAT compliance for individual sellers.
Cross-Border B2C Sales
When a UAE business sells goods online to a consumer outside the GCC:
- The supply may be zero-rated (export of goods) with proper documentation.
- Customs export declarations are required.
When a non-UAE business sells goods online to a UAE consumer:
- Import VAT (5%) applies when the goods enter the UAE.
- For low-value consignments, the marketplace or courier may account for VAT.
Destination Principle
VAT on digital services follows the destination principle:
- Taxed where the consumer is located.
- If the consumer is in the UAE, UAE VAT applies (5%).
- If the consumer is outside the UAE, no UAE VAT.
Identifying the Recipient's Location
Non-resident suppliers determine the recipient's location using:
- Billing address
- Bank account location
- IP address
- SIM country code
- Payment method country
At least two non-contradictory indicators should be used.
Worked Example
A UAE e-commerce business sells AED 100,000 of goods online to consumers in the UK. The goods are exported — zero-rated with customs documentation. A UK e-commerce business sells AED 200,000 of goods to UAE consumers. The goods are imported — import VAT (5%) applies when they enter the UAE. The marketplace (if deemed supplier) may account for the VAT.
